Survey Scope
1-3 Charles Street comprised a 35-bedroom sheltered housing scheme, which had been occupied on full repairing and insuring lease terms for 5 years. To complete the survey, we took photos of all rooms within the building and noted all defects and required repairs. We could then utilise this information and refer to the lease to determine what elements should be included in the claim and what should not.
Challenges
Consul was tasked with negotiating a reduction in the terminal schedule of dilapidations for our Client utilising our commercial knowledge.
Solution
Consul achieved a 39% (over £75K) reduction on the initial Terminal Schedule of Dilapidations served upon them.
Result & Benefits to St Mungo’s
- Consul reduced the dilapidations served on St Mungo’s by showing a thorough understanding of Dilapidations case law and Lease covenants; not to mention the detailed assessment of the site recognising the works, relating to the Lease and landlord claim, undertaken during the lease period.
- Consul showed resolve and a robust approach through negotiations to close this out against an experienced Landlord team, which proved successful.
