Project Requirement & Process
Consul was approached by Orbit housing initially to assist with party wall matters relating to a block where they are the leaseholder. The works required renewing the roof which had an inherent defect. Following an extensive review of the proposals and legal documentation we advised that a party wall award was required but established that scaffold licences would be required so the works could be undertaken in a safe manner.

Survey Scope
Following a meeting on site and discussions with the project team it was established that agreement from several surrounding premises would be required. These premises were shops and a car park that would be operating on a normal working basis.
We therefore reached out to the adjoining owners where access was required to start the process of putting an agreement between the two parties.

The adjoining owners did not want any impact on their land and although we worked with the contractor and project team to design out several areas of contention some impact would be inevitable.

Although we were generally in agreement with the surveyors working for the other side, certain legal questions were being raised which is beyond our expertise. We therefore advised our Client in order to proceed lawyers would need to be involved to answer these questions to proceed with the required works.
Result & Benefits to Orbit
Consul provided excellent advice and feedback to Orbit and the project team in an attempt to resolve a very complicated situation with the adjoining owners to allow vital roof renewal works to be undertaken.
